Tribunal allows Sifuna-led group to reserve ‘The Mwananchi Party’ amid name dispute

NAIROBI, Kenya — The Political Parties and Disputes Tribunal (PPDT) has issued interim orders protecting the names and identities claimed by the competing political formations behind Linda Mwananchi and the Liberty National Democratic Alliance (LINDA) pending the determination of an ongoing appeal.

In preliminary orders issued during a virtual proceeding, the tribunal allowed the reservation and registration of “The Mwananchi Party” to proceed pending the hearing and determination of the appeal.

The tribunal also allowed the reservation and registration of Liberty National Democratic Alliance (LINDA) to continue.

At the same time, the PPDT restrained the Registrar of Political Parties from considering, processing, reserving or registering the name “Linda Mwananchi”, or any substantially similar variation, for another person or entity until the appeal is determined.

The case is scheduled to resume on September 14, 2026, at 2:30pm.

Nairobi Senator Edwin Sifuna, who is associated with Linda Mwananchi, said the legal dispute was primarily about protecting the movement’s name and public identity rather than establishing another political party.

Speaking at Ufungamano House in Nairobi on Tuesday during a keynote address on the participation of young aspirants in politics, Sifuna said the group had challenged the Registrar of Political Parties because it believed there was no sufficient basis to deny it the name.

“We took the Registrar to court because we do not believe he has any reason to deny us the name. But I want to be clear: what we are fighting for is not a party. We have parties. We are fighting for a brand, our name,” Sifuna said.

The remarks underline the growing importance of the Linda Mwananchi identity as political formations position themselves ahead of the 2027 General Election.

The interim order prevents another entity from securing the disputed name or a similar variation while the tribunal considers the appeal.

Officials associated with the Liberty National Democratic Alliance also welcomed the tribunal’s decision, maintaining that the LINDA name belongs to their political formation.

Party officials led by leader Phanesio Thuku insisted that the LINDA identity was rightfully theirs.

The two sides subsequently entered into a consent allowing the reservation and registration of Liberty National Democratic Alliance (LINDA) and “The Mwananchi Party” to continue pending the hearing and determination of the appeal.

The consent provides temporary protection for both names but does not amount to a final determination of ownership of the disputed political identities.

The PPDT’s orders are therefore interim in nature and will remain in force as the parties await the substantive hearing.

The dispute places political branding and party identity at the centre of an increasingly competitive pre-election environment, where names, symbols and public recognition can play a significant role in mobilising voters.

The tribunal is expected to hear the appeal on September 14, when the parties will have an opportunity to present their substantive arguments.

Until then, the Registrar of Political Parties remains barred from processing a new registration or reservation of “Linda Mwananchi” or a similar name for another entity.
