Kenyan national detained by U.S ICE after Tennessee tractor-trailer crash

The suspect, identified as Eric Maloba, was involved in the crash while reportedly acting as an instructor to a commercial driver's license (CDL) trainee.

TENNESSEE, United States — A Kenyan national has been taken into custody by US Immigration and Customs Enforcement (ICE) after a tractor-trailer crash in Hamblen County, Tennessee, in a case the agency has held up as an example of its intensifying enforcement drive against non-citizens holding commercial driver’s licences.

Eric Maloba was arrested on 28 August in Hamblen County, roughly 45 minutes northwest of Knoxville, following the crash. ICE said Maloba holds a Commercial Driver’s Licence (CDL) issued in Texas and was reportedly instructing a trainee seeking a commercial licence at the time of the collision.

“A 287(g) Task Force partner arrested Eric Maloba, an illegal alien from Kenya, following a tractor-trailer crash. Investigators determined Maloba was reportedly instructing a commercial driver’s license trainee,” the agency said in a statement.

According to ICE, Maloba entered the United States legally in October 2018, but his authorised period of admission expired in April 2019, meaning he had remained in the country beyond his legal status for more than seven years at the time of his arrest.

He is currently being held in Knoxville pending immigration court proceedings that will determine whether he is removed from the country.

Notably, ICE’s public statements on the case have not alleged that Maloba’s immigration status caused the crash, nor have they described any criminal charges arising from the collision itself. Details such as the cause of the crash, any injuries, or the trainee’s identity have not been released.

Maloba was taken into custody through the federal 287(g) programme, which allows designated state and local law enforcement agencies to carry out specified immigration enforcement functions in partnership with ICE.

In Hamblen County, the sheriff’s office participates in the programme’s Warrant Service Officer model, while the Tennessee Highway Patrol operates under its Task Force model.

Under Tennessee law, it is a Class A misdemeanour for a person without legal immigration status to operate a commercial vehicle, a provision that requires local authorities to notify ICE following such arrests — a state-level pipeline that funnels routine traffic and licensing enforcement directly into federal immigration proceedings.

ICE Assistant Director Russell Hott described the 287(g) partnership model as a critical public safety initiative, while an ICE spokesperson framed the case in broader terms: “Our message is clear: If you come into our country illegally and break our laws, we will find you, arrest you and remove you.”

The agency also linked the case to Homeland Security Secretary Kristi Noem’s deputy, Markwayne Mullin, saying: “Eric’s case shows exactly why [the department] is cracking down on illegal aliens with CDLs, strengthening border security, encouraging 287(g) partnerships and ramping up removals.”

Maloba’s case has been publicised by ICE alongside a batch of other 287(g) partner arrests, including cases involving prior convictions and repeat re-entrants, as part of a broader campaign under the Trump administration targeting non-citizens who hold commercial driving credentials.

Federal officials have said the effort is aimed at closing regulatory gaps that have allowed undocumented individuals or visa overstayers to obtain and retain state-issued CDLs, and have linked the focus to concerns over road safety as well as immigration enforcement.

A significant proportion of undocumented immigrants in the US initially entered the country lawfully, on student, tourist or temporary work visas, before remaining past their authorised departure date.

Enforcement actions against this group have grown as data-sharing between federal agencies has expanded, making it easier to identify and act on visa overstays long after the fact.

Maloba’s detention comes as the Department of Homeland Security has published a list of 125 African nationals facing removal proceedings, with Kenyan nationals accounting for nearly half of those named, alongside individuals from countries including Ghana, Mauritania, Morocco and South Africa.

An estimated 150,000 to 160,000 Kenyans live in the United States, forming a diaspora community concentrated particularly in Texas, California, Georgia, Minnesota and Washington.

Over the past two years, expanded US deportation efforts have placed hundreds of Kenyan nationals in removal proceedings over status violations, visa overstays or underlying criminal convictions, as the Trump administration has extended immigration enforcement activity beyond the border into workplaces and communities across the country.
